The instant petition has been filed under Section 528 of BNSS 2023 (482 Cr.P.C) for setting aside the order dated 19.12.2025 passed by Addl. Sessions Judge, Panchkula whereby the suspension of sentence granted to the petitioners has been cancelled and directions have been issued to take them into custody and for quashing/ modification of the condition imposed vide order dated 03.07.2024 to deposit 20% of the compensation amount. 2. Learned counsel for the petitioner contends that the condition of depositing 20% of the amount awarded by the trial Court for hearing the appeal is not compliable as the petitioner is not in a position to pay/deposit the said amount. 3.
