Through the present Appeal, the Appellant [Original Defendant] assails the correctness of the Judgment and Decree dated 28.06.2024 [hereinafter referred to as „Impugned Judgment‟] passed by the learned Single Judge, decreeing the Respondent‟s [Original Plaintiff] suit for specific performance of the Memorandum of Understanding (MoU) dated 14.02.2020, while exercising powers under Order XIII-A of the Code of Civil Procedure, 1908 [hereinafter referred to as „CPC‟] amended by the Commercial Courts Act, 2015. 2. In order to comprehend the issues involved in the present case, relevant facts in brief are required to be noticed. 3. For the sake of convenience, the parties hereinafter are referred to as they were
