The petitioner has filed the instant petition under Articles 226/227 of the Constitution of India, seeking issuance of a writ of mandamus directing the respondents to count the period of military service (05 years and 05 months) rendered by the petitioner in his net qualifying service for the purpose of pensionary benefits in view of Rule 4.3 of Punjab Civil Service Rules (Vol-II) (Annexure P-3) and to re-fix the pension of the petitioner after counting aforementioned period in his qualifying service and grant him all the consequential benefits accordingly. 2. After arguing the case for sometime and realizing that the Court is not inclined to interfere in the matter as there is a considerable delay in approaching the Court as the petitioner retired from service, on attaining the age of superannuation on 31.03.2000, learned counsel for the petitioner wishes to withdraw the instant petition. 3.
