It is submitted by learned counsel for the applicant as well as in the application that on the date of dismissal, the counsel for the applicant could not appear before the Court due to some clerical mistake in informing the date. His absence was not intentional. He had been representing the petitioner and therefore, there was no occasion for the petitioner to appear.
