The respondent- Ajay Pratap Singh filed a petition for divorce against the appellant herein who was at the material point of time, the wife of respondent-Ajay Pratap Singh. That case was decided ex parte on 31.01.2012 by the court of Additional Principle Judge, Family Court, Kanpur Nagar which came to the knowledge of the appellant on 10.04.2012, allegedly by a telephonic call which is given by one Smt. Sadhna Singh, who is the second wife of the respondent-late Ajay Pratap Singh. After the appellant came to know about the order, she filed an application for restoration against the order of the learned trial court granting divorce to the respondent dated 31.01.2012 and also filed another case bearing no.594 of 2012 on 30.04.2012 before the court of the Principle Judge, Family Court, Kanpur Nagar, in
