Present petition has been filed by the petitioner under Section 528 of BNSS for quashing of impugned order dated 05.12.2025 (Annexure P-3) passed by learned Sub Divisional Judicial Magistrate, Phul, Bathinda in FIR bearing No.35 dated 21.06.2024 registered under Sections 61/1/14 of Punjab Excise Act, 1914 at Police Station Sadar Rampura, District Bathinda, whereby, the bail/surety bonds of the petitioner have been cancelled and forfeited to State and his non-bailable warrants were issued against him. 2. Learned counsel for the petitioner contended that on 05.12.2025 due to some unavoidable circumstances, the petitioner could not appear before the trial Court.
