Heard Sri Gaurav Kumar Shukla, learned counsel for the applicant, Sri Rakesh Kumar Mishra, learned A.G.A. for the State and perused the record. 2. The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 338 of 2025, under Section 103(1) of Bhartiya Nyaya Sanhita and Section 3/25 Arms Act, Police-Station- Parasrampur, District Basti, during the pendency of the trial. 3. Contention of learned counsel for the applicant is that the applicant was not named in the FIR, wherein the allegation was made that some unknown person had killed the son of the first informant. Subsequently, in the statement of the first informant recorded on the same day, the name of the applicant and co-accused Shiva Saini surfaced as the persons who were involved in the murder of the deceased.
