The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 445 of 2025, under Sections- 103(1), 3(5), 115(2), 351(3) of B.N.S., corresponding Sections 302, 34, 323, 506 I.P.C., Police Station- Rasra, District- Ballia , during the pendency of the trial. 3. Contention of learned counsel for the applicant is that he was not named in the FIR subsequently on the basis of statement of two alleged eye- witnesses name of the applicant was also surfaced as one of the assailants alongwith other four accused persons who have fired upon the deceased.
