The present appeal under Section 413 B.N.S.S. has been filed against the judgment and order dated 20.03.2026 passed by Additional Sessions Judge/F.T.C. Court No. 01, Azamgarh, in Session Trial No.100243 of 2020 (State Vs. Shubham Gond and others) arising out of Case Crime No.158 of 2020, under Section 120-B of I.P.C., Police Station Mubarakpur, District Azamgarh. Through the aforesaid judgment, the trial court has acquitted the accused / opposite party nos. 2 and 3 of the charge under Section 120-B IPC. The prosecution case, in short, was that the daughter of the first informant was enticed by the main accused Shubham Gond in the night of 15th/16th August, 2020 and was raped.
