The present appeal under Section 413 B.N.S.S. has been filed against the judgment and order dated 30.03.2026 passed by the Additional Session Judge, Court No.01, Azamgarh in Session Trial No. 224 of 2021 (State of U.P. vs. Yogesh Morya) arising out of Case Crime No. 81 of 2021 and registered under Sections 498A, 304-B IPC alternative Section 302 IPC and 3/4 D.P. Act, Police Station Bardha, District Azamgarh whereby the trial court has acquitted the accused. The prosecution case in short is that Sheela Maurya (hereinafter referred to as, 'the deceased') was married to the opposite party Yogesh Morya on 24.8.2019. The accused / opposite party used to harass the deceased for dowry and subsequently killed the deceased at 08:00 p.m. on 11.04.2021 by hanging her. A first information report was lodged on 12.04.202
