The first prayer for bail of the appellant was rejected by a co-ordinate Bench of this Court vide order dated 18.05.2023 passed in Criminal Appeal No. 4349 of 2023 (Umesh @ Lukka Vs. State of U.P. and Another), the copy of the order is annexed as Annexure-7 to the affidavit. The said order reads as under:- "Heard Shri M.P.S. Chauhan learned counsel for the appellant; Shri Bipin Kumar, learned counsel for the opposite party no.2 learned AGA for the State and perused the material placed on record. The present criminal appeal under Section 14-A(2) Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act has been filed by the appellant, to set aside the impugned order
