The present appeal has been filed for quashing the cognizance/summoning order dated 1st April, 2025 as well as the entire proceedings of Sessions Case No. 2761 of 2025 (State Vs. Santosh), arising out of Case Crime No. 99 of 2025, under Sections 316 (2), 318 (4), 351 (2) of B.N.S. and Section 3 (2) (5A) of SC/ST Act, Police Station-Atrauli, District-Aligarh, pending in the Court of Special Judge (S.C./S.T. Act), Aligarh. 3. Learned counsel for the appellants submits that the appellant has been summoned under Sections under Sections 316 (2), 318 (4), 351 (2) of B.N.S. and Section 3 (2) (5A) of SC/ST Act vide order dated1st April, 2025. It is further submitted that both Sections 316 (2) and 318 (4) of B.N.S. i.e. Sections 406 and 420 I.P.C. respectively, ca
