The present writ petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to release the retiral benefits of the petitioner, including leave encashment, gratuity, G.I.S., transportation/luggage charges and incentives for the year 2020, along with interest on delayed payment. 2. The admitted position which emerges from the record is that the petitioner superannuated from service on 31.07.2020 while two criminal cases, namely FIR No.325 dated 30.06.2003 and FIR No.67 dated 08.06.2016, were pending against him. However, the petitioner stood acquitted in both the said cases vide judgments dated 09.06.2007 and 27.08.2021 respectively.
