(Oral) The instant petition has been filed for quashing of complaints bearing No.NACT/879/2025 and NACT/854/2025 both dated 15.01.2025 under Section 138 to 142 of the Negotiable Instruments Act, 1881 alongwith subsequent proceedings arising therefrom but not limited to orders dated 27.03.2025, 09.04.2025, 11.08.2025 and 19.09.2025, 20.11.2025 respectively. Learned counsel for the petitioner contends that at the time of filing of present petition, only a pre-summoning notice was issued, however, during the pendency of the present petition, the petitioner has also been summoned, he, thus, seeks withdrawal of the same so as to file a fresh petition not only on the same cause of action but also challenging the subsequent developments taken place.
