The present Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 [“Act”], seeking the appointment of a Sole Arbitrator to adjudicate the disputes inter se the parties arising out of the Facility Agreement dated 29.09.2023 [“Agreement”], read with the General Terms & Conditions. 2. Material on record indicates that the Arbitration Clause is set out as Clause 20 of the General Terms & Conditions. The same reads as follows: “20. ARBITRATION AND JURISDICTION 20.1 Any and all disputes, claims, differences arising out of or in connection with this Agreement and the Schedule/s attached hereto or the performance of this Agreement shall be settled by arbitration to be referred to a sole arbitrator to be appointed by BIZLOAN and Signature Not Verified Digitally Signed ARB.P. 412/2026 Page 1 of 8 By:HARVINDER KAUR BHATIA Signing Date:19.05.2026 15:06:20 the award thereupon shall be binding upon the Parties to this Agreement.
