231 IOIN-3-FAO-41-2005 IN FAO-41-2005 BALKAR SINGH Vs NASIB SINGH & ORS. Present : None for appellant. Mr. Praveen Kumar, DAG Haryana. **** In the present case, notice has been issued to counsel for the appellant as well as counsel for the respondent No.1 but none has appeared on their behalf. A perusal of award shows that Insurance Company has been directed to deposit the awarded amount and has been given a right to recover the same from the owner/respondent No.2 i.e. Haryana Roadway Chandigarh Depot, who is represented by State counsel. As such, there is no necessity to issue notice to respondent No.1-driver. IOIN disposed of. The main case is ordered to be taken on board today itself. MAIN CASE There is no representation on behalf of the appellant. In the said circumstances, Mr. Bhaskar Sorout, Advocate (Enrollment No.PH-3837-2017) present in the Court is appointed as Amicus Curiae to assist the Court in the present case.
