Aggrieved by the red tape and non-release despite being eligible for pre- mature release, the petitioner has come up before this Court by filing the present petition under Article 226 of Constitution of India. 2. Short reply by way of affidavit filed by State counsel is taken on record. A copy thereof has been supplied to counsel for the petitioner. 3. Counsel for the petitioner submits that the petitioner is in Open Air Jail.
