Learned counsel appearing on behalf of the petitioner has contended that the present petition has been filed challenging the proceedings under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961 (for short the ‘Act of 1961’), however, prior to the order issuing notice of motion, the possession was taken. Learned counsel has further contended that a petition filed under Section 11 of the Act of 1961 is pending before the Additional Deputy Commissioner Development, Hoshiarpur exercising the powers of Collector under Section 11 of the Act of 1961. Learned counsel for the petitioner states that he be permitted to withdraw the present petition with liberty to pursue the petition filed u
