The present application under Section 528 B.N.S.S. has been filed with the prayer to allow this application and quash the entire proceedings as well as Charge Sheet dated 25.10.2021 along with cognizance/summoning order dated 05.09.2023 passed by the Additional Civil Judge (J.D.), Court No. 3, Allahabad in Case No. 537 of 2023 (State Vs. Atul Pandey), arising out of Case Crime No. 250 of 2021, under Section 174-A I.P.C., Police Station Sarai Mamrez, District Allahabad including the consequential proceedings of case, pending in the court of A.C.J.M., Court No. 6, Allahabad. 3. The brief facts of the case are that an F.I.R. being Case Crime No. 642 of 2020, under Sections 304, 323, 325, 504, 506 I.P.C. and Section 3(2)(v) SC/ST Act was lodged against the applicant at Police Station Sarai Mamrez, District Allahabad.
