Succinctly, facts of the case are that the FIR in the present case was registered on the statement of complainant, namely, Santosh Kumar. It was alleged that he and Sushil Kumar were employed in Railway Department from the last 12 years. The complainant knew Abhishek Malhotra @ Laddi (petitioner) as his father Deepak Kumar had family relations with him.
