The petitioner has preferred the present petition with the prayer to direct the respondent No.2/District Magistrate, Etah & respondent No.3/Sub Divisional Magistrate, Tehsil Aliganj, District Etah to restrain the respondent no.4/Manoj Yadav from creating Chak Marg through Gata No.629 of the petitioner. 2. From perusal of the record as well as the relief sought by petitioner, the Court is of the opinion that relief has been sought by the petitioner is against the private persons, the mandamus cannot be issued against the private persons and the petitioner has the remedy under the common law remedy. 3. In this view of the matter, the present petition is dismissed with liberty to the petitioner avail the remedy under common law. (Prakash Padia,J.)
