Facts in brief are that the petitioner Nos.1 and 3 and respondent No.3 are real sisters and the daughter of Sri Krishna Mohan Tiwari, who was the owner of the house situated in Sidhauli Town, Pargana and Tehsil Sidhauli, District Sitapur. In the year 2009, a dispute arose with respect to the partition and ownership of the aforesid house. The respondent-Jyotika claimed 1/5th share in the house and filed Civil Suit No.417 of 2009 int he court of Civil Judge (Senior Division), Sitapur, praying for decree of partition with respect to her 1/5th share in the property.
