In the present case few facts are not under dispute that FIR No. 0427 dated 26.09.2018 was lodged against petitioner at Police Station Nuria, District Pilibhit under Sections 452, 354(A)(1)(i), 504, 506 IPC, 7/8 POCSO Act and 3(2)(v) SC/ST Act. After investigation a final report dated 02.11.2018 was submitted and it appears that on basis of a protest petition an order was passed to register a case and thereafter cognizance was taken and summons were issued against petitioner.
