The facts which are not under much dispute are that petitioner’s father died in harness on 07.10.1998 and subsequently petitioner was granted compassionate appointment vide appointment letter dated 26.08.2000 on the post of Junior Clerk in Government Polytechnic, Ghaziabad. 3. It is the case of petitioner that he was qualified for appointment on the post of Office Draftsman and at that stage there was a post vacant also still arbitrarily respondents have not given appointment according to his qualification. 4.
