The writ petitioner claims to be the second wife of late Anil Kumar Thapa who was appointed in PAC Department on the post of Cook, however, the husband of the writ petitioner expired and the marriage stood dissolved with respect to the deceased with the first wife and the writ petitioner's name does not find place in the nomination column but the writ petitioner claims grant of pensionary benefits and compassionate appointment. 3. Learned Standing Counsel submits that the claim of the writ petitioner needs adjudication at the first instance by second respondent, Commandant, 9th Battalion, PAC, Moradabad, District Moradabad. 4.
