The special appeal was filed in 2006 by the State of U.P. challenging the judgment and order dated 05.12.2005, however, the appeal itself was filed on 04.07.2006 with a delay of about 5 months 27 days. 3. We have gone through the affidavit filed in support of the application for condonation of delay and do not find the explanation to be satisfactory.
