The special appeal was filed in 2006 by the State of U.P. challenging the judgment and order dated 05.05.2006, however, the appeal itself was filed on 30.06.2006 with a delay of about 9 months. 3. We have gone through the affidavit filed in support of the application for condonation of delay and do not find the explanation to be satisfactory. We have also been informed that the judgment has already been complied. We accordingly reject the application for condonation of delay in filing special appeal. 4.
