JUSTICE MANOJ JAIN J U D G M E N T (oral) 1. Petitioner seeks quashing of FIR No. 423/2025 dated 10.10.2025, registered at P.S. Mandawali Fazal Pur, for commission of offence under Sections 318(4)/336(3)/338/340(2)/3(5) of BNSS (corresponding Sections 420/468/467/471/34 IPC) along with all consequential proceedings arising, therefrom. 2. Charge-sheet is yet to be filed. 3. The FIR in question was registered at the instance of respondent no.2 Sh. Rajesh Khillan, who stated that the petitioners had cheated him by trying to sell a property which was not free from encumbrances. After making part payment of Rs.70 lakhs, when he had gone for the registration of the abovesaid property, he learnt that the property could not have been sold as there was some case going on regarding the property and that there was a ‘stay’ as well.
