The instant appeal has been preferred against the judgment and award dated 28.10.2015 passed by the Motor Accident Claims Tribunal/Additional District Judge, E.C. Act, Lucknow (hereinafter referred to as the 'Tribunal') in M.A.C.P. No.251 of 1998. 3. Brief facts of the case are that on 23.03.1998 one Anil Singh, who was working as Security Guard, was returning home with his friend namely Ramesh Kumar Tiwari. On around 10:30pm., one scooter bearing registration no.UP78P7371, which was being driven rashly and negligently, dashed into Anil Singh as a result of which, he sustained serious head injuries and subsequently succumbed to the same.
