Heard Sri Amberish Kumar, the learned counsel for the petitioner, Sri Mayank Sinha, the learned A.G.A. appearing on behalf of the State and perused the records. 2. By means of the instant petition filed under Article 226 of the Constitution of India the petitioner has challenged the validity of an order dated 03.10.2013, passed by learned Additional Chief Judicial Magistrate, Court no.32, Lucknow in Case No.2020 of 2013, whereby while discharging the petitioner from the offences under Sections 406, 467, 468, 471 I.P.C. the learned trial court has rejected the petitioner's request for being discharged from the offence under Section 420 I.P.C.
