Court No. - 69 HON'BLE ARUN KUMAR SINGH DESHWAL, J. 1. Heard Ms Haya Rizvi, learned counsel for the applicant, Sri Roshan Kumar Singh, learned A.G.A. for the State and perused the record. 2. The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No.427 of 2025, under Sections- 303(2), 317(2) BNS, Police Station-Baraut, District- Baghpat, during the pendency of the trial. 3. Contention of learned counsel for the applicant is that the applicant was not named in the FIR. Subsequently, on the joint possession of the applicant and the co-accused, the motorcycle mentioned in the FIR has been shown to be recovered after six months of the incident but procedure of Section 105 BNSS has not been followed. It is further submitted that the applicant has explained the criminal history of seven cases in the accompanying affidavit.
