Applicant seeks bail in Case Crime No. 579 of 2025, under Sections 137(2), 64(2) BNS and 5J(ii)/6 POCSO Act, Police Station Chiluwatal, District Gorakhpur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The victim seems to be a consenting party as is but evident from her statement recorded under Section 183 B.N.S.S. whereby she had gone to the applicant on being called by him and thereafter she went to some place with him, where he is stated to have established corporeal relation with her.
