Court No. - 67 HON'BLE SAMEER JAIN, J. 1. Heard Sri Byas Kumar Prasad, learned counsel for the applicant and Sri Rajiv Dhar Dwivedi, learned AGA for the State. 2. The instant bail application has been filed seeking release of the applicant on bail in Case Crime No.0435 of 2025, under Sections 331(4), 305(a), 317(2) and 61(2) BNS, Police Station Jagdishpura, District Agra, during pendency of the trial. 3. Learned counsel for the applicant submits, however, applicant was not named in the FIR but during investigation he has been made accused on the basis of false recovery of alleged stolen mobile phone. 4. He next argued, all the offences are triable by Magistrate. 5. He next submits, applicant is having criminal history of five other cases but his criminal history has been duly explained in the supplementary affidavit filed in support of the instant bail application and in all the cases applicant is on bail. 6.
