The present bail application has been filed on behalf of the applicant with the prayer to release him on bail during trial in F.I.R./Case Crime No. 327 of 2022, under sections 8/20 N.D.P.S. Act, Police Station- Rupaideeha, District- Bahraich. As per prosecution version, the contraband substance, i.e. 2 Kg of Charas is said to be recovered from the possession of the applicant. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case due to ulterior motive. The alleged recovery is false and planted. Although the recovered contraband is above the commercial quantity, but there is no independent witness to the said recovery. Moreover, there is no compliance of 52-A of N.D.P.S. Act a
