The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No.05 of 2026, under Sections- 103(1), 309(6), 117(2), 61(2) of BNS, Police Station-Dataganj, District-Budaun, during the pendency of the trial. 3. Contention of learned counsel for the applicant is that in the FIR, the allegation of killing the deceased has been made on the basis of apprehension and doubt. Subsequently, the applicant was arrested and from the applicant, Rs.50,000/- and some jewellery was also recovered. However, from the co-accused, Himanshu Gupta, Rs.60,000/- was recovered.
