The present appeal under Section 413 BNSS has been filed by the father of the person allegedly murdered and against the judgment and order dated 04.02.2026 passed by Session Judge, Hamirpur acquitting the accused in Session Trial No.43 of 2019 (State of U.P. vs. Ajay Tiwari and Anr.) under Sections 302, 34, 201 I.P.C., P.S. Sumerpur, District Hamirpur acquitting the accused/opposite party nos.2 & 3 arising out of Case Crime No.0482 of 2018 P.S. Sumerpur, District Hamirpur. The opposite party no. 3 in the present appeal is the daughter-in-law of the appellant and the wife of the person allegedly murdered. On 03.11.2018, an application was filed by one Aditya Kumar Sahu to the Station House Officer, Police Station Sumerpur, informing that Dev Narayan Sahu (hereinafter referred to as 'the deceased') was found dead at 9:00 a.m. in a room at his home. The dead body was found hanging
