The instant Criminal Appeal under Section 374(2) CrPC has been filed against judgment and order dated 22.02.2005 passed by the Additional Sessions Judge - V, Faizabad, in Sessions Trial No.204 of 2000, State v. Sati Ram Verma, arising out of Case Crime No. 121 of 1999, under Section 436 I.P.C., Police Station Ibrahimpur, District Ambedkar Nagar, convicting and sentencing the appellant as under:- (i) under Section 435 I.P.C. to one year rigorous imprisonment and a fine of Rs.5,000/- and in default of fine, six months additional imprisonment (ii) Out of realized fine, an amount of Rs.1,000/- shall be paid to the complainant-Ram kewal Verma as damages. 3.
