The present appeal under Section 374(2) of the Criminal Procedure Code has been preferred against the judgment and order dated 20.10.2004 passed by the Court of Additional Sessions Judge, Court No. 5, Lakhimpur Kheri in Sessions Trial No. 49 of 1995 (arising out of Crime No. 90 of 1992) of Police Station Sampurnanagar, District Kheri, convicting the appellant under Section 323 I.P.C. and sentencing him to 6 months Rigorous Imprisonment with a fine of Rs. 1,000/- (and in default of payment of fine to further undergo one month imprisonment), and under Section 324 I.P.C. for a period of 2 years Rigorous Imprisonment with a fine of Rs. 3,000/- (and in default of payment of fine to further undergo three months imprisonment).
