The instant Criminal Appeal under Section 374(2) CrPC has been filed against judgment and order dated 16-7-2007 passed by Addl. District & Session Judge F.T.C.-V, Lucknow, in Sessions Trial No.40 of 2005, State v. Phool Kumari, arising out of Case Crime No. 210 of 1987, under Section 363,366 I.P.C., Police Station Mohanlalganj, District Lucknow, convicting and sentencing the appellant as under:- (i) under Section 363 I.P.C. to four years rigorous imprisonment and a fine of Rs.1,000/- and in default of fine, one month's additional rigorous imprisonment (ii) under Section 366 I.P.C. to five years rigorous imprisonment and a fine of Rs.1,000/- and in default of fine, one month's additional rigorous imprisonment (ii) All sentences shall run concurrently. 3.
