The present appeal under Section 374(2) of the Code of Criminal Procedure, 1973, has been preferred against the judgment and order dated 28.07.2004 passed by the Court of Additional Sessions Judge/Fast Track Court No. 5, Gonda in Sessions Trial No. 450/1996, arising out of Crime No. 200/1994 of Police Station Kotwali Nagar, District Gonda (current District- Balrampur), convicting the appellant under Section 324 I.P.C. and sentencing him to undergo two years of rigorous imprisonment along with a fine of Rs. 3,000/-, and in default of payment of fine, to further undergo three months of simple imprisonment.
