The instant Criminal Appeal under Section 374(2) CrPC has been filed against judgment and order dated 27.04.2010 passed by the Additional Sessions Judge, Court No.6, Raebareli, in Sessions Trial No.131 of 2000, State v. Ram Naresh and others, arising out of Case Crime No. 85 of 1997, under Sections 279, 338, 427, 308, 323, 506 I.P.C., Police Station Bhadokhar, District Raebareli, convicting and sentencing the appellants as under:- (i) under Section 308 I.P.C. to four years rigorous imprisonment and a fine of Rs.1,000/- each and in default of fine, two months additional imprisonment (ii) under Section 325 IPC to three years imprisonment and a fine of Rs.1,000/- each and in default of fine, two months additional imprisonment (iii) under Section 323 I.P
