Heard Sri M.S. Khan learned counsel for the appellants and learned A.G.A. for the State as well as perused the record. The present criminal appeal has been filed under Section 374(2) Cr.P.C. against the judgement and order dated 27.8.2002 passed by the Special Judge, Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act/Additional Sessions Judge, Sultanpur, in Sessions Trial No.229 of 1992, whereby appellant no.1 has been convicted under Section 307 IPC and sentenced to seven years R.I. and further convicted under Section 429 IPC and sentenced to three years R.I., and appellant no.2 has been convicted under Section 307/34 IPC and sentenced to seven years R.I. and further convicted under Section 429/34 IPC and sentenced to three years R.I. As per the prosecution case, the complainant Gherau son of Shiv Singh lodged complaint on 15.2.1991
