The present 528 B.N.S.S. application has been filed to quash the summoning order dated 05.07.2024 passed by the learned Chief Judicial Magistrate Auraiya as well as entire proceedings of Complaint Case No. 5063 of 2023 (Brijendra Singh@ Bijendra Singh Vs Satish Chandra alias Kallu), under section 138 of N.I Act, Police Station Kotwali, District Auraiya, pending in the Court of Chief Judicial Magistrate, Auraiya. 3. It is submitted by learned counsel for the applicant that there is money dispute between the parties and opposite party no.2 has filed a complaint under Section 138 of N.I. Act against the applicant.
