Instant application has been filed to quash the entire proceedings of Case No. 11007 of 2016 (Satya Prakash vs. Jugnu), under Section 138 Negotiable Instruments Act, P.S. Sadar Bazar, District Agra, pending in the Court of A.C.-1st, Agra. 3. The facts of the case is that the complaint under Section 138 N.I. Act has been lodged by the opposite party no. 2 against the applicant in the court of Additional Judicial Magistrate-V, Agra. After recording statement of complainant under Section 200 Cr.P.C. and taking documentary evidence, the judicial magistrate summoned the applicant under Section 138 N.I. Act. 4. Counsel for the applicant submits that applicant is innocent and has been falsely implicated in the case.
