This application u/s 528 B.N.S.S. has been filed by the applicant for quashing the summoning order dated 27.01.2021, N.B.W. order dated 02.08.2023 passed by the Chief Judicial Magistrate, Jalaun at Orai in Complaint Case No.3888 of 2019 (Krishan Kumar vs. Rajendra Prasad Sharma), under section 138 N.I. Act, Police Station Kotwali Orai, District Jalaun at Orai. 3. The facts of the case are that the complainant initiated proceeding under section 138 N.I.Act alleging therein that the applicant had taken Rs.21,00,000/- in cash for providing a plot in Agra City, Sandhya Vihar, Mauja Chhalesar (Jharnanala). After some dispute between the parties regarding the plot, as the applicant did not hand over the plot to the complainant.
