Sri Moeez Uddin, learned counsel for the accused/applicant appears and submits that the accused/applicant is one of the co-accused in the case of murder of four years old child of the informant, who has been appeared as prosecution witness-1 on 08.05.2018. Counsel for the co-accused-Pramod has cross examined PW-1 Yasweer son of Gaje Singh but learned counsel for the accused/applicant Kavita did not appear for the cross examination and therefore, the cross examination was stated to be 'Nil'. Learned counsel submits that the punishment of murder is extended to death penalty. The trial court must be cautious in dealing with the trial, which is punished with harsher punishment. The entire prosecution evidence have been recorded. The statement of accused under Section 313 CrPC and defense witness have already been recorded.
