The petitioners herein were working as Livestock Inspectors when the Gujarat Civil Services (ROP) Rules were brought into force, whereby a revised scale of pay from immediate subsequent 01.01.1986 was granted. However, the rules required that an option be exercised within the prescribed time i.e., on or before 30.12.1988. 2. Admittedly, this option was not exercised by the petitioners and, therefore, the benefits were not extended to them. The learned Single Judge has found that the petitioners retired during the period from 2004 to 2008 and that they had chosen to approach the Tribunal only in the years 2004 and 2006 and he has, therefore, concluded that the petitioners had not explained the delay in approach
