DOSHI CAV JUDGMENT 1 This appeal under Section 96 of the Code of Civil Procedure, 1908 (for short “the Code”), has been preferred by the appellants assailing the judgment and decree dated 22.09.1998 passed by learned City Civil Court, Ahmedabad, whereby the suit filed by the plaintiff came to be decreed and the defendants were directed to pay a sum of Rs.45,400/- as compensation for the loss caused to the plaintiff’s properties during the communal riots that occurred on 13.07.1986. 2. For the sake of brevity and convenience, the parties are referred to their original status and position of the learned City Civil Court. 3. In nutshell, the case of the plaintiff is that, he had been carrying on the business of tailoring under the name and style of "Action Tailors" at 66, New Gujarat Kabadi Market No.2, Behrampura, Ahmedabad, for about two years prior to the incident.
