In utter fairness, learned AGP Ms.Tripathi and learned advocate Mr.Rutvij Oza appearing for appellant Nos.1 and 2 respectively, while referring to the judgment of the Division Bench of this Court in First Appeal No.2500 of 2009 and allied matters, submitted that the issue involved in the present matter stands concluded by the decision rendered in the aforesaid appeals. Therefore, this Court may decide the First Appeal and permit the appellants to bring on record the the legal heirs/representatives of the deceased-respondent Nos.1, 3 and 5 in the appeal proceedings. 2. The land situated at Village Rantej, Taluka Becharaji, District Mehsana, was acquired for the purpose of construction of the Narmada Canal. The notification under Section 4 of the Land Acquisition Act, 1894 (for short ‘the Act’) was published on 12.11.1999, and the notification under Section 6 of the Act was published on 08.08.2000.
