A Writ Petition under Article 226/227 of the Constitution of India read with Sections 528/529 of BNSS, has been filed on behalf of the Petitioner to challenge the Order dated 07.12.2024 of learned ASJ, Delhi, whereby the Application of the Petitioner for Inspection of Malkhana, as per Guidelines for Inspection of Malkhana, has been dismissed. 2. The Petitioner filed an Application on 21.09.2024 seeking inspection of Malkhana of the Investigating Agency that would contain the case property i.e. the material seized by the Investigating Agency, but not filed along with the Chargesheet. 3. Upon issuance of the Notice, no written response was filed by the Prosecuting Agency. The learned Special Judge dismissed this Application, by the impugned Order dated 07.12.
